France and Article 42(7) of the Treaty on the European Union

    Wednesday, 18 November, 2015

In response to the recent terrorist attacks in Paris France invoked Article 42(7) of the Treaty in the European Union on 17 November 2015. That article obligates all EU Member States to provide France with aid and assistance, although it does not go so far as to confer a security commitment, akin to NATO's Article V. This paper looks briefly at Article 42(7) TEU and the implications for the UK.

Japan: Abe’s constitutional and security agenda

    Monday, 02 March, 2015

Prime Minister Shinzo Abe and the ruling Liberal Democratic Party (the LDP) won a decisive victory in snap elections held in December 2014. One of the reasons for holding early elections was Abe’s desire to amend Japan’s ‘peace Constitution’ so that in future it expressly permits the country’s armed forces to come to the aid of allies under attack. This is known in Japan as the right of ‘collective self-defence’. In mid- 2014 the Japanese Cabinet approved interpreting the Constitution in this way. Abe is now seeking to give this new interpretation legal and constitutional underpinning. Important as it is, amending Article 9 of the Constitution is just one part of Abe’s plans on the defence and security front. Japan is now looking to enhance its defence capabilities so that it can play a greater role in promoting international “peace, stability and prosperity”. It will also increase its ability to respond effectively to any attack on the Senkaku Islands (as Japan calls them) in the East China Sea.

Conference on the Humanitarian Impact of Nuclear Weapons

    Wednesday, 19 November, 2014

On 8-9 December interested parties will convene in Vienna for the Conference on the Humanitarian Impact of Nuclear Weapons. This will be the third conference on this issue in two years and is the result of an increasing focus by the non-nuclear weapon states on a previously little-debated aspect of the nuclear weapons debate: the humanitarian consequences of their use. On 2 December the British government announced that it would attend the Vienna conference, in contrast to the two previous conferences on this subject.

    UK-USA Mutual Defence Agreement

    Monday, 20 October, 2014

The Mutual Defence Agreement allows the US and UK to exchange nuclear materials, technology and information in order to improve their atomic weapon design, development and fabrication capabilities. The most important part of the MDA is due to expire at the end of 2014 and therefore an amendment treaty, which will extend this deadline to 2024, must be ratified by both States and brought into force by the end of this year.

Military and Humanitarian Assistance to Iraq

    Monday, 08 September, 2014

The substantial gains made by Islamic State fighters in the last few months, which has seen ISIL forces advance on the northern city of Irbil and forced thousands of people from religious minorities to flee their homes, has prompted the US, UK and other Western governments to take more concerted action in Iraq.

The EU’s Common Security and Defence Policy: A Fresh Impetus?

    Wednesday, 04 December, 2013

The European Council Summit is due to be held on 19-20 December 2013. Among the main issues for debate is the EU’s Common Security and Defence Policy (CSDP). It will be the first time in five years that EU leaders have comprehensively discussed EU defence policy, amid criticisms that CSDP has lost momentum due to a lack of consensus over its strategic direction, an unwillingness on the part of Member States to commit the necessary resources and the prevailing economic crisis which has seen defence budgets fall across Europe and capabilities cut.

Report Stage and Third Reading of the Defence Reform Bill

    Tuesday, 26 November, 2013

Report Stage and Third Several amendments were tabled prior to Report stage, including one which sought to impose an obligation on the Government to report on the viability and cost-effectiveness of the plan to increase the size of the Reserves, which would then be subject to approval by both Houses before the Government could continue with its reform agenda. Despite the support of several Conservative backbenchers, that amendment was, however, defeated on division. A clause seeking to increase the leave entitlement of Reservists was also defeated. Reading of the Defence Reform Bill took place in the House of Commons on 20 November 2013.
